Local bike shop has damaged my frame

Hi all,

My ebike has been at my local bike shop for several months for a suspect battery issue which turned out to be a faulty motor. I decided to get the bike back from the shop while I consider what to do with the bike and if I want to put a new motor on it at the cost of over £1000. It currently has a non-functional motor.

It was dark when I picked the bike up so couldn't see it, the next day I noticed there is significant damage to the top tube from the levers hitting it when the bars spin round. It looks to me like it's been knocked over several times to be able to cause this much damage.

I'm not even sure what could be done to fix this and what I should be asking the local bike shop to do to resolve it.

They should be rectifying the damage as its in there care its there problem
Your issue is if they get funny and say they didnt do it , you removed the bike from the premises with out raising the problem with them
I would get back to them and start the ball rolling and not take no for an answer
